1. Agreement to Terms

By accessing or using ThriftyThumbs ("the Service"), operated at thriftythumbs.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

ThriftyThumbs is a platform that provides AI-powered YouTube thumbnail generation and A/B testing. The Service allows you to:

• Generate AI thumbnails using text prompts and reference images
• Run A/B tests on your YouTube video thumbnails and titles
• View analytics and performance data for your YouTube videos
• Collaborate with team members on thumbnail creation and testing

3. Account Requirements

To use the Service, you must:

• Be at least 13 years of age
• Provide accurate account information
• Be authorized to grant ThriftyThumbs access to your YouTube channel(s)
• Keep your account credentials secure

You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

4. YouTube Channel Access

By connecting your YouTube channel, you authorize ThriftyThumbs to:

• Read your video metadata, analytics, and channel information
• Upload and change thumbnails on videos you select for testing
• Update video titles during active title tests
• Access YouTube Analytics data for videos under test

You retain full ownership and control of your YouTube channel. You can revoke access at any time through your Google Account settings or the ThriftyThumbs settings page. ThriftyThumbs will restore your original thumbnail and title when a test ends or is stopped.

You acknowledge that A/B testing involves changing your video's thumbnail and/or title, which may temporarily affect your video's performance. ThriftyThumbs is not responsible for any changes in views, impressions, or revenue that result from A/B testing.

5. AI-Generated Content

Thumbnails generated through our AI tools are created for your use. You own the rights to use AI-generated thumbnails for your YouTube videos and related promotional purposes.

You agree not to use the AI generation feature to create:

• Content that violates YouTube's Community Guidelines
• Misleading or deceptive thumbnails (clickbait that misrepresents video content)
• Content depicting illegal activities, violence, or exploitation
• Content that infringes on third-party intellectual property or likeness rights

We reserve the right to refuse generation requests and suspend accounts that violate these rules.

6. Subscription & Billing

ThriftyThumbs offers free and paid subscription plans. Paid subscriptions are billed monthly through Stripe.

• Billing cycle: Subscriptions renew automatically each month on the date you subscribed
• Plan changes: Upgrades take effect immediately. Downgrades take effect at the next billing cycle
• Cancellation: You may cancel at any time through the billing settings. Access continues until the end of your current billing period
• Refunds: We offer refunds on a case-by-case basis within 7 days of a charge. Contact support for refund requests
• Usage limits: Each plan includes a set number of AI thumbnail generations per month. Unused generations do not roll over

7. Affiliate Program

ThriftyThumbs offers a referral program with 30% recurring commission. By participating, you agree to:

• Promote ThriftyThumbs honestly and not misrepresent the Service
• Not use spam, misleading ads, or unauthorized trademark usage to drive referrals
• Not self-refer or create fake accounts to earn commissions

Commissions are subject to a 30-day hold period and a $50 minimum payout threshold. We reserve the right to withhold or reverse commissions obtained through fraudulent means and to terminate affiliate accounts that violate these terms.

8. Acceptable Use

You agree not to:

• Use the Service to violate any law or YouTube's Terms of Service
• Attempt to gain unauthorized access to other users' accounts or data
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools (bots, scrapers) to access the Service without permission
• Resell or redistribute the Service without authorization
• Interfere with or disrupt the Service's infrastructure

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service depends on third-party APIs (YouTube, Google, Stripe) that may experience downtime or changes beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice. We will make reasonable efforts to notify users of material changes.

10. Limitation of Liability

To the maximum extent permitted by law, ThriftyThumbs and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of YouTube revenue, views, or subscribers
• Changes in video performance resulting from A/B tests
• Downtime or errors in AI thumbnail generation
• Inaccuracies in analytics or test results
• Actions taken by YouTube or Google on your channel

Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless ThriftyThumbs from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

12. Intellectual Property

The Service, including its design, code, branding, and features, is owned by ThriftyThumbs. You may not copy, modify, or distribute any part of the Service without permission.

You retain ownership of your YouTube content, uploaded images, and custom thumbnails. By uploading content to ThriftyThumbs, you grant us a limited license to store, process, and display that content solely to provide the Service.

13. Termination

We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or abuse the Service. You may delete your account at any time through the settings page.

Upon termination, your right to use the Service ceases immediately. We will make reasonable efforts to restore your original YouTube thumbnails and titles for any active tests before account deletion.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on this page. Your continued use of the Service after changes constitutes acceptance. If you disagree with updated terms, you should stop using the Service and cancel your subscription.

15. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these terms or the Service shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
